By accessing or using the services of Blake Fitzgerald Golf (“we,” “our,” or “us”), you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Definitions

• “Client”: Refers to any individual who books or participates in a session with Blake Fitzgerald Golf.

• “Services”: Refers to the golf coaching sessions, use of facilities, and any other offerings provided by Blake Fitzgerald Golf.

2. Booking and Payment

• Booking: Sessions must be booked via our online booking system.

• Payment: Payments can be made online via credit card or in person with cash. Payment must be completed before the session begins.

3. Cancellation and Refund Policy

• Cancellations: Clients can reschedule or cancel up to 48 hours before their appointment for a full refund or alternative date. Cancellations made less than 48 hours before the session will not be refunded.

• Change of Mind: Refunds are available for change of mind if the cancellation is made at least 48 hours in advance.

4. Late Arrival and No-Show Policy

• Late Arrivals: A 10-minute grace period is allowed for late arrivals, but any lost time is forfeited.

• No-Shows: If a client does not show up without prior notice, the booking cost is forfeited, or the session may be rescheduled at our discretion.

5. Use of Facilities and Conduct

• Equipment: Clients must bring their own clubs or use the clubs provided at our facility. All equipment must be clean and in good condition.

• Attire: Appropriate golf attire and closed-in footwear are required. Thongs, sandals, slippers, dirty work boots, or bare feet are not permitted.

• Behaviour: Clients must conduct themselves in a polite and orderly fashion. Disruptive behaviour, including profanities, yelling, or any action causing discomfort to others, will not be tolerated.

• Prohibited Items: No alcohol, illicit drugs, or outside food and beverages are to be brought on to the premises.

6. Health and Safety

• Assumption of Risk: Clients acknowledge that golf carries a risk of injury. By booking a session, clients accept full responsibility for any injuries sustained.

• Medical Conditions: Clients are responsible for disclosing any relevant health information that may affect their participation.

7. Liability and Indemnity

• Limitation of Liability: To the fullest extent permitted by law, Blake Fitzgerald Golf is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services.

• Indemnity: Clients agree to indemnify and hold harmless Blake Fitzgerald Golf from any claims arising out of their use of the facilities or breach of these terms.

8. Memberships and Packages

• Multi-Session Packages: Terms regarding expiration dates, transfers, and cancellations will be provided upon purchase.

• Non-Transferable: Memberships and packages are personal and cannot be transferred to others.

9. Privacy

• Data Collection: We collect personal information as outlined in our Privacy Policy.

• Use of Data: Personal information is used to provide services, process payments, and communicate with clients.

10. Intellectual Property & Copyright

• Ownership of Content

  • All content available on the Blake Fitzgerald Golf website, and coaching materials—including but not limited to videos, images, written materials, lesson plans, digital downloads, and training content—is protected under Australian copyright laws and international copyright treaties.

  • The content is owned by Blake Fitzgerald Golf and may not be copied, reproduced, modified, distributed, or used for commercial purposes without explicit written permission.

• Restricted Sharing & Use of Member Site Content

  • If you have access to exclusive coaching materials, you must not share, distribute, or publicly post any of the protected assets, including lesson videos, training images, or proprietary resources.

  • Unauthorised sharing of content may result in termination of lessons or bookings, legal action, and liability for damages.

• Copyright Infringement & Reporting

  • If you believe that any content on our website has been used without permission or infringes on copyright laws, please contact us at bfitzgerald@pgamember.org.au with the following details:

    • A description of the copyrighted work that has been infringed.

    • A link or description of where the infringing content is located.

    • Your contact details (name, email, phone number).

    • A statement confirming that you are the copyright owner or authorized to act on their behalf.

• Prohibited Commercial Use

  • You may not use any of Blake Fitzgerald Golf’s content for commercial purposes, including but not limited to:

  • Reselling or redistributing our coaching materials.

  • Creating derivative works based on our videos, images, or lesson plans.

  • Using our logo, branding, or proprietary content in any advertisements, marketing, or business materials without permission.

• Enforcement & Legal Action

  • We take copyright violations seriously. Unauthorised use of our content may result in:

    • Immediate termination of services or access to Member Site materials.

    • Legal action, including claims for damages and injunctive relief.

    • Enforceable takedown notice (for copyright violations on online platforms). 

11. Amendments

Blake Fitzgerald Golf reserves the right to amend these terms and conditions at any time. Changes will be effective upon posting on our website.

12. Governing Law

These terms and conditions are governed by the laws of New South Wales, Australia.
